1. Who you are dealing with
As required by section 43 of the Electronic Communications and Transactions Act 25 of 2002:

2. Agreeing to these terms
By placing an order you agree to these terms. Please read them first. They are governed by South African law.
Nothing in these terms limits your rights under the Consumer Protection Act 68 of 2008 (“CPA”) or the Electronic Communications and Transactions Act (“ECTA”). Where a term conflicts with those Acts, the Act prevails.
3. Our books are second-hand — please read this clause
Every item we sell is pre-owned. Most of it comes from a private collection built up over fifty years. This is the most important thing to understand about buying from us.
- The photograph on each listing is of the actual copy you will receive. It is not a publisher’s stock image. What you see is the book we will send you.
- We hold one copy of each title. When it sells, the listing closes. If we later acquire another copy we may list it again, but it will be a different physical book in a different condition.
- Second-hand books show wear. Expect reading creases, shelf wear, faded spines, previous owners’ names and occasional marks. We describe significant faults, but not every minor blemish. The photograph is the best guide.
- Unless a listing says otherwise, books are complete and readable.
Because these are used goods sold in the condition shown and described, section 55(6) of the CPA applies: the implied warranty of quality does not extend to the specific characteristics of wear that we have disclosed and that you accepted by placing the order. It does still apply to anything we failed to disclose.
4. Prices
All prices are shown in South African Rand (ZAR). We are not registered for VAT, so no VAT is charged on your order.
Delivery is charged separately and is shown before you confirm your order.
We try to keep prices accurate. If an item is listed at an obviously incorrect price, we will contact you before processing the order, and you may confirm at the corrected price or cancel for a full refund.
5. Placing an order
Your order is an offer to buy. A contract comes into existence only when we confirm the order and accept your payment.
We may decline an order if the item has already sold, if it turns out to be damaged beyond what we described, or if we cannot verify your details.
6. Payment
We accept payment by electronic funds transfer (EFT) only. We do not accept cards.
- Our banking details are sent to you in your order confirmation email.
- Please use your order number as the payment reference. Without it we cannot match your payment and your order will be delayed.
- Your order is held for 7 days while we wait for payment. If nothing is received in that time we cancel it and the item goes back on sale.
- Nothing is packed or shipped until payment reflects in our account.
7. Delivery and collection
Delivery is by courier, anywhere in South Africa, at the buyer’s cost. The charge is calculated and shown at checkout before you confirm.
Orders with payment cleared before 13:00 are dispatched the same business day. Courier transit is typically 1 to 3 business days. These are estimates, not guarantees, and we are not responsible for delays caused by the courier.
Collection is available by appointment only at 107 Klip Street, Hennopspark, Centurion, Monday to Saturday between 09:00 and 13:00. Please arrange a time and wait for confirmation that your order is ready before travelling.
Risk in the goods passes to you on delivery or collection. Ownership passes once we have received payment in full.
Please give an address where somebody can receive the parcel. If a delivery fails because nobody was available or the address was wrong, a second delivery is charged again.
8. Your right to cancel — 7-day cooling-off
Section 44 of ECTA gives you the right to cancel an order placed online within 7 days of receiving the goods, without giving any reason.
- Email us at admin@factsandfiction.net within that period.
- Return the item in the condition you received it.
- You pay the cost of returning it.
- We refund the price of the goods within 30 days of the return reaching us.
This right does not apply to sealed audio recordings, video recordings or software that you have unsealed, as ECTA excludes them.
9. Faulty, damaged or misdescribed items
If an item arrives damaged in transit, is materially different from its description and photograph, or has a fault we did not disclose, contact us within 7 days of delivery with a photograph.
We will, at your election, repair, replace or refund it, and we pay the return shipping in these cases. This is in addition to your rights under section 56 of the CPA.
Ordinary wear consistent with a second-hand book, shown in the photograph or described in the listing, is not a fault.
10. Cancellation by us
If we cancel your order — because the item is unavailable or was misdescribed — we refund you in full within 14 days, to the account the payment came from.
11. Your account
If you create an account, keep your password confidential and tell us promptly if you think someone else has used it. You are responsible for activity under your account.
We may suspend or close an account used for fraud, abuse, or to place orders that are never paid.
12. Our liability
We are responsible for supplying the goods you ordered, in the condition described.
To the extent the law allows, our total liability arising from any order is limited to the amount you paid for that order. We are not liable for indirect or consequential loss.
Nothing here limits liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be limited.
13. The website itself
We try to keep the site accurate and available, but we do not guarantee it will be uninterrupted or error-free. Listings, photographs and descriptions on this site belong to us and may not be copied or reproduced without our permission.
14. Your privacy
How we handle your personal information is set out in our Privacy Policy, which forms part of these terms.
15. Changes
We may change these terms. The version that applies to your order is the one published when you placed it.
16. Governing law and disputes
These terms are governed by South African law, and the courts of South Africa have jurisdiction.
Please contact us first — most disputes are settled quickest that way. You also have the right to refer a complaint to the National Consumer Commission or to a recognised consumer-goods ombud.
